TERMS OF SERVICE

1. General

These Terms of Service govern all orders, quotes, and transactions with MetalStairs Co., operating in New Brunswick, Canada. By submitting a quote request or placing an order, you agree to these terms in full.

MetalStairs Co. reserves the right to refuse service to any client at its discretion.

2. Quotes

All quotes are valid for 30 days from the date of issue. After 30 days, material and labour pricing is subject to change and a revised quote may be required before proceeding.

3. Deposits and Payment

A deposit of 50% of the total order value is required to confirm your order and begin production. The remaining balance is due upon completion, before delivery or pickup.

Submitting a deposit authorizes MetalStairs Co. to purchase materials specific to your order and to begin work on your project. These costs are non-refundable once incurred, regardless of the reason for cancellation.

The full order total is due before delivery or installation. MetalStairs Co. reserves the right to hold completed products until payment is received in full.

4. Lead Times

Lead times provided at the time of quoting are estimates only. MetalStairs Co. is not liable for delays caused by supplier availability, material shortages, shipping delays, or any circumstances beyond our control. We will communicate any significant delay as soon as it is known.

5. Price Changes on Delayed Orders

If a client delays the start of their project more than 30 days after quote acceptance, or pauses an active project for more than 30 days without prior arrangement, MetalStairs Co. reserves the right to revise pricing to reflect current material and labour costs before proceeding.

6. Client Responsibilities

The client is responsible for ensuring the installation site is ready by the agreed date. This includes but is not limited to: framing complete, stair opening cleared, and safe access for our team. Delays caused by site unreadiness may affect your lead time and scheduling priority.

If the client provided their own measurements, the client assumes full responsibility for their accuracy. MetalStairs Co. is not responsible for fit issues resulting from measurements we did not take. We strongly recommend booking our On-Site Measurement service.

7. Design Approval and Changes

Once a design or drawing has been approved and production has begun, any requested changes may result in additional charges and extended lead times. Changes are not guaranteed to be possible once fabrication is underway.

8. Intellectual Property

All designs, drawings, renders, and technical documents created by MetalStairs Co. remain the exclusive property of MetalStairs Co. until the order is paid in full. These materials may not be shared, reproduced, or used by the client or any third party without written permission.

9. Limitation of Liability

MetalStairs Co.'s total liability to the client, for any reason, shall not exceed the total amount paid by the client for the specific order in question. MetalStairs Co. is not liable for any indirect, incidental, consequential, or special damages, including but not limited to loss of use, loss of income, or property damage beyond the product itself.

10. Governing Law

These terms are governed by the laws of the Province of New Brunswick and the applicable laws of Canada. Any disputes will be resolved in the jurisdiction of New Brunswick.
